I have a pre-existing condition, cobra exhaust, and the spouse has a group plan.

Can I get a plan under HIPAA eligibility, or do I have to go on her plan? (Her plan is even more expensive than the HIPAA eligible plans)

Her companies insurance advisor said I'd have to go on hers because HIPAA eligible excludes people who can get ANY other group coverage. The sales rep at AETNA said no - only if I have personally offered group coverage.

The answer to your question is virtually impossible to answer. The best way to find out would be to apply for the HIPAA plan you want. If declined, you still have the group option.
